AtData, LLC, and our subsidiary XVerify, LLC (“AtData”) comply with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) as set forth by the U.S. Department of Commerce. AtData has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (“EU-U.S. DPF Principles”) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. AtData has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (“Swiss-U.S. DPF Principles”) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.
If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. The Federal Trade Commission has jurisdiction over AtData’s compliance with the EU-U.S. DPF, UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.
AtData commits to subject to the DPF Principles all personal data received from the EU, UK, and Switzerland in reliance on the relevant DPF.
Information about the types of personal data collected, the purposes for our data collection and use, as well as the types of third parties with whom we share personal data and purposes for this sharing can be found in the AtData Privacy Policy.
AtData may be required to disclose personal data in response to law requests by public authorities, including to meet national security and law enforcement requirements.
Residents of the EU, UK, and Switzerland have the right to access the personal data that AtData maintains, and in some cases, have choices to limit the use and disclosure of personal data. These rights are described more fully in the “Your Choices,” “European Economic Area, Switzerland, and United Kingdom Visitors,” and “Your Rights” sections of the AtData Privacy Policy. AtData is accountable for the processing of personal data it receives under the EU-U.S. DPF Principles, and the UK Extension to the EU-U.S DPF, and the Swiss-U.S. DPF Principles and subsequently transfers to a third party. AtData complies with the DPF Principles for all onward transfers of personal data from the EU, UK, and Switzerland, including the onward transfer liability provisions.
In compliance with the EU-U.S. DPF, UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, AtData commits to resolve DPF Principles-related complaints about our collection and use of your personal data. EU, UK, and Swiss, individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF should first contact AtData as described in the “Contact Information” section below.
In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, AtData commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF to Association of National Advertisers (“ANA”), an alternative dispute resolution provider based in the United States. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://www.ana.net/content/show/id/accountability-dpf-consumers for more information or to file a complaint. The services of ANA are provided at no cost to you. Under certain conditions, more fully described on the DPF website, you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.
